1. Agreement to Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between E23 Digital LLC (“Company,” “we,” “us,” or “our”), a limited liability company organized under the laws of the State of California, and you (“Customer,” “you,” or “your”) regarding your purchase and use of the ActBlue Random Donor Display WordPress Plugin (the “Plugin”).

By completing a purchase through our storefront at store.e23.digital, powered by Lemon Squeezy, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not purchase or use the Plugin.

3. Description of the Plugin

The ActBlue Random Donor Display WordPress Plugin is a software product designed to integrate with WordPress websites and display randomly selected donor information sourced from ActBlue fundraising campaigns. The Plugin is provided as a digital download following purchase.

We reserve the right to update, modify, or discontinue any features of the Plugin at our discretion. We will endeavor to provide notice of material changes through our website or via email.

4. License

4.1 Grant of License

Upon purchase, E23 Digital LLC grants you a limited, non-exclusive, non-transferable, revocable license to install and use one (1) instance of the Plugin on a single WordPress installation (“License”). Each license is associated with one unique license key.

4.2 License Key

Your license key is personal to you and must not be shared, resold, sublicensed, or transferred to any third party. Each license key activates a single site installation. You are responsible for maintaining the confidentiality of your license key.

4.3 Restrictions

You may not:

Copy, distribute, or resell the Plugin or any portion thereof
Modify, reverse engineer, decompile, or disassemble the Plugin
Use the Plugin on more than one website per license key without purchasing additional licenses
Remove or alter any proprietary notices, labels, or marks on the Plugin
Use the Plugin for any unlawful purpose or in violation of any applicable laws or regulations

5. Pricing and Payment

All payments are processed securely through Lemon Squeezy at store.e23.digital. Prices are subject to change; however, any pricing changes will not affect your current active subscription term.

Your subscription will automatically renew annually at the then-current rate unless you cancel prior to the renewal date. You are responsible for ensuring your payment method on file with Lemon Squeezy remains current and valid.

6. No Refund Policy

ALL SALES ARE FINAL. Due to the digital nature of the Plugin, E23 Digital LLC does not offer refunds, credits, exchanges, or prorated reimbursements for any reason, including but not limited to:

Change of mind after purchase
Incompatibility with your WordPress theme, hosting environment, or third-party plugins
Failure to use the Plugin
Cancellation of your subscription prior to the end of the billing period
Dissatisfaction with Plugin features or functionality

By completing your purchase, you expressly acknowledge and agree to this no-refund policy. If you have questions about the Plugin before purchasing, please contact us at plugins@e23.digital.

7. Subscription Renewal and Cancellation

Your license subscription renews automatically on an annual basis. You may cancel your subscription at any time through your Lemon Squeezy account or by contacting plugins@e23.digital. Cancellation will take effect at the end of the current billing period. No refund will be issued for any unused portion of the subscription term.

Upon expiration or cancellation of your subscription, your license key will be deactivated and you must cease use of the Plugin.

8. Support

E23 Digital LLC provides customer support for the Plugin via email at plugins@e23.digital. We will make reasonable efforts to respond to support inquiries within a reasonable timeframe, but we do not guarantee specific response times or resolution of all issues.

Support is limited to issues directly related to the Plugin’s functionality as designed. Support does not include customization, integration with third-party services beyond ActBlue, or issues arising from modifications made by the Customer.

9. Third-Party Services

The Plugin is sold through Lemon Squeezy, a third-party payment and storefront platform. Your use of the Lemon Squeezy storefront is subject to Lemon Squeezy’s own terms of service and privacy policy. E23 Digital LLC is not responsible for the acts or omissions of Lemon Squeezy.

The Plugin is designed to work with the ActBlue fundraising platform. E23 Digital LLC is not affiliated with, endorsed by, or sponsored by ActBlue. Any changes to the ActBlue platform that affect the Plugin’s functionality are outside our control.

10. Intellectual Property

The Plugin, including all associated code, documentation, graphics, and other materials, is and remains the exclusive intellectual property of E23 Digital LLC. These Terms do not convey to you any ownership rights in the Plugin. All rights not expressly granted herein are reserved by E23 Digital LLC.

11. Disclaimer of Warranties

THE PLUGIN IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, E23 DIGITAL LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

E23 DIGITAL LLC DOES NOT WARRANT THAT THE PLUGIN WILL BE ERROR-FREE, UNINTERRUPTED, SECURE, OR THAT DEFECTS WILL BE CORRECTED. YOU ASSUME ALL RISK ASSOCIATED WITH THE USE OF THE PLUGIN.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL E23 DIGITAL LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE PLUGIN.

IN ANY EVENT, E23 DIGITAL LLC’S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE PLUGIN IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless E23 Digital LLC and its members, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in connection with: (a) your use of the Plugin; (b) your violation of these Terms; or (c) your violation of any applicable law or the rights of any third party.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Plugin shall be subject to the exclusive jurisdiction of the state and federal courts located in Alameda County, California.

Before initiating any formal legal proceeding, you agree to first contact E23 Digital LLC at plugins@e23.digital and provide a written description of the dispute. The parties will attempt to resolve the dispute informally for a period of thirty (30) days.

15. Changes to These Terms

E23 Digital LLC reserves the right to modify these Terms at any time. We will provide notice of material changes by updating the effective date at the top of this document and posting the updated Terms at e23.digital. Your continued use of the Plugin after the effective date of the revised Terms constitutes your acceptance of the changes.

16. Entire Agreement

These Terms constitute the entire agreement between you and E23 Digital LLC with respect to the Plugin and supersede all prior or contemporaneous understandings, agreements, representations, and warranties, whether written or oral, regarding the Plugin.
